When will your clients stop asking you for a BEE certificate?

This is a difficult one to answer.  It’s not in the nature of South African big business to rebel against government legislation.  This is generally left to lobby groups like Sakeliga, who are supported by a wide variety of companies across the spectrum.  

If we use e-Tolls as an example.  OUTA made a case that the tolls were not supported in law and encouraged citizens to avoid paying the tolls.  It took at least 10 years before the whole e-Toll programme was scrapped.

We don’t think that it will take 10 years for BEE to disappear, it’s definitely on life-support but is unlikely to fall out of fashion in the next 3-5 years.  There’s too much at stake for the largest political party to scrap or relax them, which is why we are reading so much about BEE in the press at the moment.  

Having noted that, it’s unlikely that there will be changes to any BEE code that might make compliance more costly and difficult.  We note the Democratic Alliance’s court case against the minister of labour over the new Employment Equity regulations, which will probably end up in the Constitutional Court.  Any other changes will probably result in more challenges.  Each one gradually weakening big business’s confidence in BEE.
