What is the future of BEE. Will it stick around?
Every business owner ponders this question. Many, perhaps most, small to medium business owners can’t wait to see the back of it. This makes sense. The implementation of a BEE programme is invasive, expensive and a drain on internal resources. With the only benefit being a certificate that allows you to trade for another year.
We are not praising BEE, nor are we going to go into the moral argument of BEE compliance. We think BEE has moved way beyond those arguments. What we are interested in is its FUTURE.
This is the first time in the twenty-odd years that we have been advising companies that we can say that BEE’s bubble is on its way to bursting. There are international pressures from the USA and the World Bank on the government to relax the ownership requirements for foreign-owned companies. There are also a number of court cases being heard in our courts at the moment that threaten to chip away at the BEE façade. The most significant case is the Legal Sector’s challenge of that code. It’s possible that other high profile law suits will follow in the mining sector.
What most commentators and service providers won’t tell you is that BEE is for the most part voluntary. Black Economic Empowerment is not law. It has become necessary because your clients insist on some form of BEE compliance. In fact the end of BEE in the economy will not come from a change in the law. It will happen because the larger companies start making BEE a requirement to do business with them. There’s not going to be a sudden change but a gradual relaxation.
