A recent article reported that a delegation from South Africa was received at the White House. One of the conditions that the White House has placed on South Africa is the “Exemption of USA entities from all Black Economic Empowerment (BEE) requirements. Any race-based legislation that may constitute a non-tariff trade barrier should not apply to USA entities”
This appears to go further than mere ownership or equity equivalent programmes for US entities operating in SA. They are suggesting that no US company will produce a BEE certificate.
Our source is a joint media statement issued by leaders of an Afrikaner Delegation following a meeting with senior White House officials on 25 June 2025. We have not seen an official document from the USA confirming this.
We are of the opinion that this is the starting point of negotiation between the White House and Pretoria. The likely outcome is that the ownership requirement will be removed altogether from foreign companies. They will be required to comply with the balance of the elements.
As we have written before BEE is on its way out.
But it’s not going to happen as quickly as this joint statement wishes it to disappear. The pressure is still going to be there.
